The Historic Environment (Amendment) (Scotland) Act 2011 (“the Act”) was passed by the Scottish Parliament on 23 February 2011.
The Act amends three pieces of primary legislation:
The Historic Buildings and Ancient Monuments Act 1953;
The Ancient Monuments and Archaeological Areas Act 1979; and,
The Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997 (“1997 Act”).
The remaining provisions of the above Act, and the suite of Regulations that are required to allow for full implementation of the Act, came into force on Thursday 1 December 2011.
